Man fined $250 for using mobile while driving a horse-drawn cart

Exclusive: IF you have been caught out by a carefully placed speed camera while driving home from work, spare a thought for Swan Valley identity Ross Gundry.

Mr Gundry, who has run Swan Valley Wagon Trails for the past 14 years, was recently nabbed by a local copper for using a mobile phone while driving his Clydesdale horse Toffee down West Swan Road.

That’s right – a horse-drawn cart.

Mr Gundry (56) said he was flabbergasted when pulled over by a motorcycle patrolman and issued with a ticket for $250.

“I’ve been operating all over Perth in the wagon trail business for more than 25 years and I’ve always used my mobile phone, believing that a horse-drawn vehicle was OK,” he said.

“After all, I’m only travelling at 2km/h.”

He said nine-year-old Toffee had regularly driven the Swan Valley route for the past four years and could “probably do it on her own”.

“I hardly drive them at all,” he said.

Wording in Section 265 of the Road Traffic Code relating to use of mobile phones was changed in March 2011 from “using a mobile phone while driving a motor vehicle” to “using a mobile phone while driving a vehicle.”

Mr Gundry reluctantly accepted the ticket but is seeking legal advice on whether he should contest the matter.

“The law is the law and if I don’t know the law that’s bad luck,” he said. “However, there has to be some commonsense.”

Mr Gundry said a “reasonable man” would have pulled him over and issued a verbal warning.

“There’s no such thing as community policing any more,” he said.

“It’s pure revenue raising, that’s all this is. I’ve been around in the Swan Valley for 14 years, so the least the policeman could have done is warn me the law had changed,” he said.

Mr Gundry said he grew up in the country with police “you respected and felt safe with”.

But it was obvious things had changed.

“If police want to be respected they should respect the public and use common sense, too,” he said.

Us tax payers have to pay stupid fines like this so our government can use the money to send Asylum seekers back to their own countries on chartered flights with $3000.00 in their pockets each. I get angry when I read about this type of police behaviour. My taxes are paying this idiot policeman’s salary. I am middle aged, middle class and conservative by nature yet I feel contempt for the police because of this. Is it any wonder teenagers do not have any respect for the police? The Minister for Police needs to tell the Police Commissioner to show some leadership and common sense and weed out officers that seem to forget they are public servants and not public persecutors. The Libs won’t be getting my vote if they can’t reign in this type of behaviour.

I have a lot of respect for the police and know a few personally whom I think are great individuals “don’t see anything rude about calling them coppers either” BUT there is always some twit in every job. A warning would’ve been enough and Ross would then know he is “apparently” committing an offence.
People need to stop complaining about everything and anything. The Swan Valley is a great place and we should be proud of it, maybe even slow down a bit and appreciate the beautiful scenery instead of complaining about horse poo on the road. If we all went back to horse and cart as a mode of transport, I’m sure we would feel safer on our roads and live longer too. Good luck getting that fine thrown out Ross!

Police should spend more time protecting us against crims than raising revenue from law abiding citizens.
A vehicle used to be defined as a conveyance requiring registration - not horses, wagons, gophers, bicycles, ride on mowers, etc.

Brilliant - this dude causes traffic to build up on that very dangerous road most weekends - how dare he use his mobile phone and take his mind off the job!!! Glad he got fined and it should have been doubled. Why should cars have to negotiate his cart in such dangerous conditions with him talking on a mobile phone. He is placing his passengers at risk, motorists and the many pedestrians in that area on a weekend!! Glad he got done!!!! If we had been tring to overtake him talking on our mobile we certainly would have copped the full brunt of the law!!

If you don't brake the rules you don't pay anything and if we all payed nothing do you think that the police would all be sacked because there is no money to pay them ? No they would still be there looking after our interests . Do we all know that it is an EXCUSE under law to, in the case of an accident involving motor vehicles and horses being driven or ridden, that the person in charge of the horse CANNOT be charged with causing the accident ...simply because the horse has a mind of its own...and is capable of ignoring the rider or driver...if it so chooses.
Unless the traffic act has been changed at all since I owned a horse, the rule still exists...
This statute alone proves the horse, ridden or driven...is NOT a vehicle in the sense of the law...it is an animal with a cart attached or with a rider on its back...'What say you, constable?

People are complaining about the horse manure on the road. I don't know if this is the case with this horse but I have always seen horses pulling carts or carriages in public to have a "poobag" attached. If the horse was on a mobile phone I could understand more why he was fined as he would have been distracted :-).

I'm an ex-traffic cop from the 70s and 80s. At that time we had green pads for official warnings that we could issue to motorists who we thought a warning would be enough to modify/instruct behaviour. Talking to a copper recently, they no longer have the capacity to issue official warnings, it's an infringement only now. Revenue raising pure and simple.

Good! This horse and cart is the most annoying thing ever... It already has different rules to everything else on the road so I dont believe using a mobile phone should be any different! If I am stuck behind it (as I regularly do) driving at 2km an hour, am I allowed to be on my phone!? Get it off West Swan road and then maybe you wouldnt get caught!

How is a horse drawn carriage any different to a car or bike etc on the road? It still has the ability to cause an accident if the person in charge of it is distracted.

However in this instance common sense prevails. if this cop really is really conscientious then he should patrol the free way there are several drivers of cars that I have witnessed using mobile phones this includes "P"plate drivers. What a joke and mockery of the the section applied to infringing this driver of a horse driven carriage.

Oh before I forget, my friend in Cali is still laughing at the report of a lady being fined for pushing a pram and using a mobile phone...the news of both incidents has gone viral.

It was a good idea having a horse drawn cart on West Swan Road several years ago, but now that the volume of traffic is increasing on a daily basis due to the ever growing population of Ellenbrook and Aveley it is downright foolhardy to continue with the use of Toffee and the cart, we have had deaths recently in the area and it must be extremely frustrating to be on such a narrow road and be confronted by a 'vehicle' travelling at 5kph. One only has to look at the cycle path to see how badly planned that is too, because the road is so narrow we have to contend with power poles popping up on the path now and again. A Perth based cycling group used to have regular Sunday morning time trials in the same area and they were banned several years ago as the police say it is too dangerous to continue. However after saying all that I do think that a warning would have been sufficient in the case of Toffee's driver. However they do say that there is no such thing as bad publicity after all.

As an ex WA Police officer (who resigned on good terms) this pin points the exact reason I left the job after 11 and a half years. These laws are put in place to save lives on our roads. I travel through the swan valley at least once a day and see Ross often. I can tell you now that common sense has not been a part of WAPOL for a long time. Most officers are there for the greater good and do an outstanding job. The others are like this twit. As for the twit commenting about the manure he leaves behind and the other genius stating that due to the volume of traffic he should not be there, get a life. You obviously have nothing better to complain about. He brings a large amount of tourists to the area with the service he offers, not to mention plain entertainment value to the locals. Get a life. Send the ticket into the OIC of the Midland Traffic Office for adjudication Ross, if he has any brains he will pull it.

Well people, If you can be charged for drunken driving or being intoxicated whilst in charge of a horse and riding on roads, or riding a push bike whilst under the influence, then being charged for drunken driving, WHY should you be excused for using your mobile whilst in charge of a haorse and cart being driven on a gazetted road ?
This guy broke the law, period, suck it up precious, and pay your fine like every one else.

This is crazy! Cops these days are just out to meet their quotas on easy targets. Just look at how many cops are out with hand held radar guns at the end of the month compared to any other time.
This poor guy doesnt even need to drive the horses for them to stay on track! I rode one of these carts for hours in Germany and the driver fell asleep (it was a long day and late in the afternoon), yet the horses took us back without his help!!

Havent the Police understood the power of social media yet? We encourage bullies to walk away, but it seems this officer just wanted to throw his weight and authority around whilst at the same time dispensing with the judicious use of commonsense that this situation called for. Did the issuing of the ticket really teach a lesson and/or encourage the public to assist police or does it set up an us and them scenario ? One would have to ask if the revenue received was worth the negative publicity to the WA police.

I'm fairly sure that a vehicle is defined as having mechanical brakes...
ie - a bike is a vehicle, but a skateboard isn't
so if the carriage has no form of mechanical brakes then it wouldn't be classed as a vehicle

Bit harsh. However it is a busy road and with all the trafic on it these days there really is no room for a horse and cart.

I couldnt think of anything worse being a pssenger on the thing with the volume of traffic and pollution it brings.

Maybe the policeman was aware of the volume of traffic and how dangerous it could be if the horse bolted because of an idiot in a car, and being on the phone maybe he would be slow to react - who knows?

The horse and carriage are brave examples of traffic calming, - that maybe should be entitled to more reflectors reflective surfaces, or more lights..

This is totally ridiculous. Maybe the police officer had reached the end of his monthly quota for fines and couldn't find anything better. If anything, the poor guy should have had a warning at the most. Wouldn't it be better if they concentrated more on speeding cars? I was sitting behind a P plate driver on Pinjar Road last week when he roared past me in a 60 km zone doing at least 80 kph and not once used indicators on either one of the round-a bouts or when he turned left into a side street. No use taking down his number plate and reporting him as they won't do anything about it anyway, instead they fine someone in a horse drawn carriage doing 2 kph.

Most police officers do use a great deal of common sense and I have a lot of respect for the difficult job they do, but it's the odd over zealous individual that tarnishes the whole police force. Like Mr Gundry I was flabbergasted for being booked for not putting my foot down at a stop sign while riding my bicycle, even though I was just about stationary. The officer initially stopped me for having no helmet, for which I have an exemption, but instead issued a ticket for going through the stop sign. I have been riding a bicycle regularly for 65 years and it's the first time I've ever copped a fine. I'm as much concerned about my own safety as the police officer - A bit of respect for his elders wouldn't have done him any harm , or indeed the police force in general.
